This document contains the General Contract Conditions governing the purchase of stays made remotely via the computer network and therefore the contract that is concluded with the users of the site belonging to the company Venezia Real Estate-Vene.R.E. Srl, based in via Guglielmo Pepe 12, Mestre Venezia, 30172, Italy, in the figure of the owner of the Palazzo Venere Apartments, used for short-term rental
In any case, the use of the online booking system contained in these sites implies the acceptance and in any case the application of these general conditions.
Venezia Real Estate-Vene.R.E. Srl reserves the right to modify the same Conditions without notice.
Acceptance of the General Conditions of Sale.
By using the online booking service and by sending the purchase order electronically, the Customer unconditionally accepts and undertakes to observe these General Conditions, declaring that he has read and accepted all the information contained therein in the pursuant to the aforementioned regulations and also acknowledging that Venezia Real Estate-Vene.R.E. Srl will not be bound to different conditions unless previously agreed in writing. Any nullity or full or partial invalidity of one or more articles of these General Conditions does not in any way affect the validity of the other articles contained in the contract, which are to be considered valid and effective.
Customer commitments.
to. The submission of the booking request implies full knowledge of the same conditions and their full acceptance.
b. The Customer undertakes and obliges, once the online purchase procedure has been completed, to print and keep these Conditions, already viewed and accepted during the booking process, in order to fully satisfy the condition set out in Articles 52 and 53 of Legislative Decree n. 206/2005.
c. To purchase the accommodation services of Venezia Real Estate-Vene.R.E. Srl you must be at least 18 years old or be of age according to the laws of the country of which you are a citizen. However, any bookings regularly completed, even if made by minors, banned or disabled, will still be fully valid and effective.
How to purchase.
On the website and on the Booking Engine of Palazzo Venere Apartments the various accommodations available from time to time are described with the relative treatment, the relative rates and the relative special conditions (including that relating to deposits, payments, cancellation of the reservation, etc. ).
These rates include VAT (except in cases of an increase in the relative rate, cases in which the Customer is required to pay the relative difference) but do not include any taxes due according to local regulations, such as the Italian tourist tax, which must be paid directly to the hotel.
b. The Customer will choose from the different available accommodations the one he likes according to the relative rate and the relative special conditions indicated at the time of booking, which are accepted at the time of placing the purchase order.
Before submitting this order and therefore before confirming the booking request, the Customer will be given a summary of the total cost of the services requested; the Customer is required to check this summary before proceeding with the payment (if foreseen by the chosen rate) or to release the credit card details as guarantee.
Depending on the rate chosen by the Customer, in making the purchase order the same Customer will be asked to choose the payment method (including bank transfer, credit card, etc.) or to enter the details of a credit card to guarantee the exact fulfillment of its obligations
After having sent the said purchase order (or, according to the provisions of the chosen rate, after having made the payment of the amount indicated in the service summary or a deposit / down payment, or after having entered the details of the credit card as guarantee) the Customer will receive an e-mail message to the address indicated by the same containing the summary of his order, the reservation number, the specifications of the service booked and the conditions of cancellation of the same.
Conclusion of the contract
The contract is concluded with the acceptance of the purchase / booking order by Palazzo Venere Apartments - Venezia Real Estate-Vene.R.E. Srl
Depending on the different rate chosen, the reservation will be definitively confirmed by Venezia Real Estate-Vene.R.E. only upon successful completion of the payment or the credit card indicated as guarantee. Srl
In the absence of such a successful outcome, the Customer cannot claim any claim.
Exclusion of the right of withdrawal
Art. 47 of Legislative Decree 6 September 2005 n. 206 c.d. "Consumer Code" expressly excludes the applicability of the discipline of contracts concluded away from business premises, of distance contracts and of the related right of withdrawal from contracts that fall within the scope of application of the regulations concerning travel, holidays and circuits “All inclusive.
Penalty in case of cancellation or early departure
The special conditions relating to the type of accommodation / rate chosen - conditions that can be consulted before purchasing on the website and on the Booking Engine of Palazzo Venere Apartments - also indicate any penalties that will be applied in case of cancellation / cancellation of the reservation by the Customer ,
In case of early departure Venezia Real Estate-Vene.R.E. Srl is entitled to payment for the entire booked period.
Refunds
Any refunds due to the Customer are made with the same payment method used by the Customer for the purchase of the service.
Beginning and end of the stay. Treatment.
In all hotels, rooms are available from 2.00 pm on the day of arrival and must be vacated by 10.00 am on the day of departure. Any early accommodation or the release of the room after these times are subject to the payment of a supplement on site.
Reports at the time of booking
The special requests or preferences possibly reported by the Client in relation to the rooms (such as: neighboring rooms, on the ground floor, with double beds, etc.) are not binding for Venezia Real Estate-Vene.R.E. Srl which will be free to accept them or not.
Rights of the Customer.
The Client, whose booking has been duly confirmed by Venezia Real Estate-Vene.R.E. Srl and then paid according to the provisions of the chosen rate, has the right to regularly use the services booked even if in compliance with the regulations of the accommodation facility.
Customer Obligations.
The Customer is obliged, at the time of departure at the latest, to pay all the fees due, even additional ones, connected to extra services / performances used by the same Customer and / or the persons accompanying him, in addition to the stay if foreseen; the credit card indicated as guarantee at the time of booking can be used by Venezia Real Estate-Vene.R.E. Srl for the payment of all due fees, including additional ones.
The Customer is also responsible for any damage suffered by Venezia Real Estate-Vene.R.E. Srl or by third parties, including other customers, caused by him or caused by people for whom he is responsible.
Rights of the hotel
If the Customer refuses to pay the due fees, even for additional services purchased on site, Venezia Real Estate-Vene.R.E. Srl, in addition to being able to use the credit card indicated as a guarantee at the time of booking, according to art. 2760 of the Italian Civil Code will also have the right of retention and lien on the client's belongings that are in the structure.
Obligations of the hotel
Palazzo Venere Apartments is required to provide the services and services booked and confirmed in a manner corresponding to its standard.
Palazzo Venere Apartments can provide the Customer with adequate replacement accommodation (of equal quality), by way of example and not exhaustively, in the event of an unusable room, in the event of an extension of the stay of the previous occupants of the room in question, in the event of overbooking. and in all cases in which the needs of the hotel require such a replacement.
Any additional costs associated with the replacement accommodation are borne by the hotel.
Liability for damage to property
Venezia Real Estate-Vene.R.E. Srl is responsible for damage suffered by the customer only if the damage occurred in the premises of the structure and the same or its employees are responsible for it.
If and inasmuch as it fails to prove that the damage was not caused by Venezia Real Estate-Vene.R.E. Srl, by its employees or by people who frequent the structure, Venezia Real Estate-Vene.R.E. Srl is liable for things brought into the premises by the Customer up to a maximum amount equivalent to one hundred times the daily price paid, even in the event of deterioration, destruction or theft of things, valuables, money and debt instruments
Venezia Real Estate-Vene.R.E. Srl, however, is not responsible when the damage or theft have occurred due to the customer, due to force majeure or the nature of the thing.
The custody of objects can be refused if they are dangerous (i.e. potentially capable of causing damage), too bulky or of excessive value.
Things are considered to have been introduced into the facility when they are taken over by a staff member of the hospitality business or are taken to a place within the accommodation facility intended for their custody.
The Customer must report the fact without undue delay to the management of the structure in order not to lose the right to compensation (Article 1785 ter of the Italian Civil Code).
Maintenance
Venezia Real Estate-Vene.R.E. Srl reserves the right to make changes and carry out maintenance, even extraordinary, to the structures, even during the period of opening to the public. As part of the necessary maintenance activities, the Customer will agree, without being able to claim reimbursements and / or compensation, for work to be carried out in the rooms or in other parts of the accommodation facility during their stay at the same.
Animals
Pets are not allowed inside Palazzo Venere Apartments
Extension of the stay
The Customer cannot expect an extension of the stay, which must always be requested in advance and then expressly accepted by Venezia Real Estate-Vene.R.E. Srl.
If the Client cannot leave Palazzo Venere Apartments on the scheduled date due to exceptional, extraordinary and unforeseeable circumstances (e.g. in the event of natural disasters, floods, strikes, etc.) and is objectively precluded from all possibilities to travel, the stay will be automatically extended for the entire duration of the impediment, even in other accommodation indicated by Venezia Real Estate-Vene.R.E. Srl.
The latter is authorized in such cases to request at least the price applied in the low season as a fee.
Legal termination of the contract - Unforeseen impossibility of Venezia Real Estate-Vene.R.E. Srl.
Venezia Real Estate-Vene.R.E. Srl can terminate the contract with immediate effect in the event that the Customer:
use the premises with serious damage to the property or make coexistence with other guests intolerable by behaving bully, rude, disrespectful, scandalous or in any case inconsiderate or is guilty of actions or omissions towards Venezia Real Estate-Vene .KING. Srl, staff, other guests and / or people who are in the hotel, punished by law as a crime
in the event that he is suffering from a contagious disease or illness whose course exceeds the agreed period of stay or in the event that special care is required.
If the enjoyment of the stay is not possible due to force majeure events (e.g. natural disaster, strike, lockout, order of the Authorities, etc.), Venezia Real Estate-Vene.R.E. Srl can terminate the contract at any time without notice and without the Customer being able to claim damages and / or compensation.
Complaints
If the customer is not satisfied with the services provided, the related complaint must necessarily be communicated without delay on the spot and directly to the management of the structure.
Applicable law and competent court
These terms and conditions, as well as the relationship between the Client and Venezia Real Estate-Vene.R.E. Srl are however governed by Italian law.
For any and all disputes that may arise between the customer and Venezia Real Estate-Vene.R.E. Srl will be exclusively competent the Court of Venice, with the exclusion of any other competent court.
"Mandatory communication pursuant to article 17 of law no. 38/2006 - Italian law punishes crimes relating to prostitution and child pornography with imprisonment, even if committed abroad ".
