General Terms and Conditions of Contract
This document contains the General Terms and Conditions of Contract governing the distance purchase of stays via an electronic network, and therefore the contract concluded with users of the website belonging to the company Venezia Real Estate-Vene.R.E. Srl, with registered office in Via Guglielmo Pepe 12, Mestre Venice, 30172, Italy, in its capacity as owner of the property Palazzo Venere Apartments, dedicated to short-term tourist rentals.
In any case, the use of the online booking system contained in the aforementioned websites implies acceptance and application of these general conditions.
Venezia Real Estate-Vene.R.E. Srl reserves the right to amend these Conditions without prior notice.
Acceptance of the General Terms of Sale
By using the online booking service and sending the purchase order electronically, the Client unconditionally accepts and agrees to comply with these General Conditions, declaring to have read and accepted all the indications contained therein pursuant to the applicable regulations, and acknowledging that Venezia Real Estate-Vene.R.E. Srl shall not be bound by different conditions unless previously agreed in writing. Any total or partial nullity or invalidity of one or more articles of these General Conditions shall not affect the validity of the other articles contained in the contract, which are to be considered valid and effective.
Client Commitments
a. Submitting a booking request implies full knowledge and complete acceptance of these Conditions.
b. Once the online purchase procedure is completed, the Client undertakes and agrees to print and keep these Conditions, already viewed and accepted during the booking process, in order to fully satisfy the condition set forth in Articles 52 and 53 of Italian Legislative Decree no. 206/2005.
c. To purchase accommodation services from Venezia Real Estate-Vene.R.E. Srl, the Client must be at least 18 years old or of legal age according to the laws of their country of citizenship. However, any bookings duly completed, even if made by minors or legally incapacitated persons, shall remain fully valid and effective.
Purchase Procedures
a. The website and the Booking Engine of Palazzo Venere Apartments describe the different accommodations available from time to time, along with their respective meal plans/treatments, rates, and special conditions (including those related to advance payments, methods of payment, booking cancellation, etc.).
These rates include VAT (except in cases of an increase in the applicable rate, in which case the Client is required to pay the difference), but do not include any local taxes, such as the Italian tourist tax, which must be paid directly at the property.
b. The Client shall select their preferred accommodation from among those available, according to the relevant rate and special conditions indicated during booking, which are accepted upon submitting the purchase order.
Prior to submitting the order and confirming the booking request, the Client will be shown a summary of the total cost of the requested services; the Client must verify this summary before proceeding to payment (if required by the chosen rate) or providing credit card details as a guarantee.
Depending on the rate chosen by the Client, when placing the purchase order, the Client will be asked to choose a payment method (including bank transfer, credit card, etc.) or to enter credit card details to guarantee the exact fulfillment of their obligations.
After sending the purchase order (or, according to the terms of the chosen rate, after making the payment of the amount indicated in the service summary, paying a deposit/down payment, or providing credit card details as a guarantee), the Client will receive an email at the address provided containing the summary of their order, the booking number, the details of the booked service, and the relevant cancellation terms.
Conclusion of the Contract
The contract is concluded upon acceptance of the purchase order/booking by Palazzo Venere Apartments - Venezia Real Estate-Vene.R.E. Srl.
Depending on the rate chosen, the reservation shall be definitively confirmed by Venezia Real Estate-Vene.R.E. Srl only upon the successful completion of the required payment or authorization of the credit card provided as a guarantee.
In the absence of such successful processing, the Client shall have no claims against the company.
Exclusion of the Right of Withdrawal
Article 47 of Italian Legislative Decree no. 206 of September 6, 2005 (the "Consumer Code") expressly excludes the applicability of the rules on contracts concluded off-premises, distance contracts, and the related right of withdrawal to contracts falling within the scope of regulations concerning travel, holidays, and package tours.
Penalties for Cancellation or Early Departure
The special conditions relating to the chosen accommodation/rate type—which can be viewed before purchase on the website and Booking Engine of Palazzo Venere Apartments—indicate any penalties applied in the event of cancellation/annulment of the booking by the Client.
In the event of early departure, Venezia Real Estate-Vene.R.E. Srl is entitled to receive payment for the entire booked period.
Refunds
Any refunds owed to the Client will be processed using the same payment method used by the Client for the original purchase.
Beginning and End of Stay
Apartments are available from 2:00 PM on the day of arrival and must be vacated by 10:00 AM on the day of departure. Any early check-in or late check-out beyond these times is subject to the payment of a surcharge on-site.
Special Requests at Booking
Special requests or preferences indicated by the Client regarding the apartments (e.g., adjacent apartments, ground floor, double beds, etc.) are non-binding for Venezia Real Estate-Vene.R.E. Srl, which remains free to accommodate them or not.
Rights of the Client
A Client whose booking has been duly confirmed by Venezia Real Estate-Vene.R.E. Srl and paid for in accordance with the chosen rate has the right to use the booked services in accordance with the rules and regulations of the property.
Obligations of the Client
The Client is required, at the latest upon departure, to pay all amounts due, including extra services utilized by the Client and/or accompanying persons, as well as the tourist tax if applicable; the credit card provided as a guarantee at booking may be used by Venezia Real Estate-Vene.R.E. Srl to charge all outstanding balances, including extra charges.
The Client is also liable for any damage suffered by Venezia Real Estate-Vene.R.E. Srl or third parties, including other guests, caused by the Client or by individuals for whom the Client is responsible.
Rights of the Property
If the Client refuses to pay the amounts due, including additional services purchased on-site, Venezia Real Estate-Vene.R.E. Srl, in addition to using the credit card provided as a guarantee during booking, shall have the right of retention and lien over the Client’s property located within the establishment pursuant to Article 2760 of the Italian Civil Code.
Obligations of the Property
Palazzo Venere Apartments is required to provide the booked and confirmed services in accordance with its standard.
Palazzo Venere Apartments may provide the Client with suitable alternative accommodation (of equivalent quality) in cases such as, but not limited to, an uninhabitable apartment, extended stay of previous occupants of the apartment, overbooking, or whenever property operational needs necessitate such a replacement.
Any additional costs associated with alternative accommodation shall be borne by the property.
Liability for Property Damage
Venezia Real Estate-Vene.R.E. Srl is liable for damage suffered by the Client only if the damage occurred on the premises and the company or its employees are responsible for it.
Unless it can prove that the damage was not caused by Venezia Real Estate-Vene.R.E. Srl, its employees, or persons visiting the facility, Venezia Real Estate-Vene.R.E. Srl is liable for items brought into the premises by the Client up to a maximum amount equal to one hundred times the daily rate paid, including cases of damage, destruction, or theft of items, valuables, money, and credit securities.
However, Venezia Real Estate-Vene.R.E. Srl is not liable when damage or theft occurs due to the Client's own act, force majeure, or the nature of the item.
The safe custody of items may be refused if they are dangerous (i.e., potentially capable of causing damage), excessively bulky, or of excessive value.
Items are considered brought into the property when taken into custody by a member of staff or placed in an area inside the facility designated for storage.
The Client must report the event to management without unjustified delay in order not to forfeit the right to compensation (Art. 1785-ter of the Italian Civil Code).
Maintenance
Venezia Real Estate-Vene.R.E. Srl reserves the right to carry out alterations and maintenance, including extraordinary maintenance, on the properties during operating periods. As part of necessary maintenance activities, the Client agrees to allow work to be carried out in the apartments or other parts of the property during their stay, without being entitled to demand refunds and/or compensation.
Pets
Pets are not allowed inside Palazzo Venere Apartments.
Extension of Stay
The Client cannot demand an extension of stay, which must always be requested in advance and explicitly accepted by Venezia Real Estate-Vene.R.E. Srl.
If the Client is unable to leave Palazzo Venere Apartments on the scheduled date due to exceptional, extraordinary, and unforeseeable circumstances (e.g., natural disasters, floods, strikes, etc.) and all travel options are objectively unavailable, the stay shall be automatically extended for the duration of the impediment, including in alternative accommodation indicated by Venezia Real Estate-Vene.R.E. Srl.
In such cases, the company is authorized to charge at least the price applied during the low season.
Termination by Law – Subsequent Impossibility for Venezia Real Estate-Vene.R.E. Srl
Venezia Real Estate-Vene.R.E. Srl may terminate the contract with immediate effect if the Client:
uses the premises in a manner that seriously damages the property or makes cohabitation with other guests intolerable by displaying overbearing, rude, disrespectful, scandalous, or reckless behavior, or commits acts/omissions against Venezia Real Estate-Vene.R.E. Srl, staff, other guests, or persons present at the property that are punishable by law as a criminal offense.
If the stay becomes impossible due to force majeure events (e.g., natural disasters, strikes, lockouts, orders of the Authorities, etc.), Venezia Real Estate-Vene.R.E. Srl may terminate the contract at any time without notice, and the Client shall have no right to claim damages and/or compensation.
Complaints
If the Client is unsatisfied with the services provided, any complaint must be communicated without delay on-site and directly to Property Management.
Applicable Law and Jurisdiction
These terms and conditions, as well as the legal relationship between the Client and Venezia Real Estate-Vene.R.E. Srl, are governed by Italian Law.
For any dispute that may arise between the Client and Venezia Real Estate-Vene.R.E. Srl, the Court of Venice shall have exclusive jurisdiction, excluding any other potentially competent court.
“Mandatory notification pursuant to Article 17 of Law no. 38/2006 – Italian law punishes offences concerning child prostitution and child pornography with imprisonment, even if committed abroad.”
